Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Memescale platform, including memescale.ai and all associated services, bots, and features (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

You must be at least 21 years of age to use our Services. By using the platform, you represent and warrant that you meet this requirement.

Memescale provides a platform for creating, deploying, and managing AI-powered Telegram bots with custom image generation capabilities. Our Services include bot provisioning, character model training, image generation infrastructure, and a management dashboard.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

Access to Memescale is authenticated through your Telegram account. You are responsible for maintaining the security of your Telegram account and for all activity that occurs under your Memescale account.

You agree to provide accurate information when using our Services and to notify us immediately at support@memescale.ai if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

You may not create multiple accounts to circumvent restrictions, quotas, or any enforcement action we have taken against a prior account.

All payments for Memescale services are made exclusively in cryptocurrency. By completing a payment, you acknowledge and agree to the following:

Refunds

You may request a full refund for any reason within 24 hours of your purchase. No questions asked. To initiate a refund, contact us at support@memescale.ai within that window and we will process it promptly. Refund requests submitted after the 24-hour period will be reviewed on a case-by-case basis at our discretion.

Model Revisions

If you are not satisfied with the result of your character model training, you are entitled to request one free revision. Contact us at support@memescale.ai and we will work with you to improve the outcome.

Subscriptions and Cancellations

Monthly subscriptions carry no cancellation fee and require no formal cancellation process. To stop your subscription, simply do not make your next payment — access will continue until the end of your current billing period and will not renew automatically.

Your model weights are preserved indefinitely, even after a subscription lapses. If you choose to return at any time, your characters and trained models will be exactly as you left them.

General Payment Terms

• Package pricing is as displayed at the time of purchase. We reserve the right to change pricing at any time, though changes will not affect already-completed purchases.
• We are not responsible for losses arising from network fees, exchange rate fluctuations, or errors in wallet addresses provided by you.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for all content generated, distributed, or transmitted through your bot(s).

You agree not to use the Services to:

• Violate any applicable local, national, or international law or regulation
• Generate, distribute, or store content that is illegal, obscene, defamatory, threatening, or that infringes the intellectual property rights of any party
• Produce or distribute content that sexualizes, exploits, or harms minors in any way
• Harass, abuse, intimidate, or harm any individual or group
• Impersonate any person, entity, or brand in a misleading or deceptive manner
• Send unsolicited messages, spam, or automated bulk communications through Telegram in violation of Telegram's own policies
• Attempt to gain unauthorized access to any part of our platform, infrastructure, or another user's account
• Use the Services in any way that disrupts, degrades, or impairs the platform or its infrastructure

We reserve the right to determine, at our sole discretion, what constitutes a violation of these standards.

Your Content

You retain ownership of the images you upload and the content you configure within your bots. By using our Services, you grant us a limited, non-exclusive license to store, process, and deliver your content solely as necessary to provide the Services to you.

Our Platform

Memescale, including the platform, software, infrastructure, design, and all associated intellectual property, is owned exclusively by us. Nothing in these Terms transfers any ownership of our platform or intellectual property to you. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of our platform without our express written permission.

Generated Images

Images generated by your bot using character models you trained on your own content are yours to use. We make no claim of ownership over generated outputs produced through your bot. However, you remain solely responsible for ensuring that the use of such outputs complies with applicable law and third-party rights.

Our Services integrate with third-party platforms including Telegram and payment processors. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

In particular, your use of Telegram through our platform must comply with Telegram's Terms of Service. Any violation of Telegram's policies that results in the suspension or removal of your bot is not our responsibility and does not entitle you to a refund.

We strive to maintain reliable access to the Services, but we do not guarantee any specific level of uptime or availability. The Services may be temporarily unavailable due to scheduled maintenance, unexpected outages, third-party failures, or factors beyond our control.

We are not liable for any loss or damage resulting from service interruptions, delays, or outages, including any impact on your bot's availability or the loss of generated content.

We reserve the right to suspend or permanently terminate your access to the Services at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason we deem necessary to protect the platform or its users.

Upon termination, your right to access the Services ceases immediately. We are under no obligation to provide a refund upon termination for cause. If you wish to voluntarily close your account, contact us at support@memescale.ai.

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be error-free, uninterrupted, secure, or free of viruses or other harmful components.

We make no representations or warranties regarding the accuracy, reliability, or completeness of any content generated through the platform.

To the fullest extent permitted by applicable law, Memescale and its operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or related to these Terms or the Services exceed the amount you paid to us in the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless Memescale and its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, your content, your bot's activity, or your violation of these Terms.

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
