By accessing our services, you represent and warrant that you are at least 21 years old. This representation is a material condition of your agreement with us. Misrepresenting your age to gain access constitutes fraudulent inducement and voids any rights you would otherwise have under these Terms.

Self-Certification

Memescale does not collect, store, or independently verify age, identity documents, or other personal information to confirm your age. Compliance is enforced entirely through your own self-certification, and you bear full legal responsibility for the accuracy of that representation.

Consequences of Misrepresentation

If you misrepresent your age to access our services, you may be subject to civil liability, including breach of contract and fraudulent misrepresentation claims, as well as statutory penalties under applicable law. We reserve the right to cooperate with law enforcement and to report suspected violations to the relevant authorities.

Any account found to belong to a user under 21 will have its access immediately and permanently terminated, without notice or opportunity to appeal.

Parental Responsibility

Parents and guardians are solely responsible for preventing access by minors in their care. Memescale does not monitor for or verify against underage use beyond the self-certification described above.

This Privacy Policy describes how Memescale ("we," "our," or "us") collects, uses, and shares information when you use memescale.ai and the services we provide, including the provisioning and operation of AI-powered Telegram bots with custom image generation capabilities.

We collect information you provide to us, information generated through your use of our services, and limited technical information necessary to operate the platform securely.

Account and Identity Information

When you authenticate with Memescale, we collect your Telegram username and numeric Telegram user ID. This is the primary identifier tied to your account. We do not collect your email address, phone number, or any government-issued identification.

Bot Configuration and Content

We store all settings and content you create through our dashboard, including bot commands, allowed group configurations, character definitions, moderation rules, and rate limit preferences. This data is tied to your account and is necessary to operate the bots you configure.

Training Images

If you use our character training feature, we store the images you upload on our servers. During the training process, these images are transferred to a secure compute environment. Once training is complete and the model weights are retrieved, that environment is destroyed. Your uploaded images remain on our servers for as long as your account is active.

Generated Images

Images produced by your bot, as well as sample images generated during the training process, are stored on our servers and delivered through our image infrastructure.

Twitter/X Information

If you activate Twitter agent functionality as part of the Combo package, we store your Twitter/X username and the configuration settings for your agent. We do not store your Twitter credentials beyond what is strictly required to operate the agent on your behalf.

Payment Information

All payments are made in cryptocurrency through a third-party payment processor. We receive confirmation of a completed payment and store your package tier and activation status. We do not collect, process, or store credit card numbers, bank account details, or any other traditional financial information.

Technical and Session Information

We collect limited technical data necessary to authenticate you and protect the platform, including your IP address (stored in partial form) and session identifiers. This information is used for rate limiting, abuse prevention, and security purposes only. It is not used for advertising or behavioral profiling.

Device and Technical Information

When you use our platform, we automatically collect certain information about the device and environment you are using. This includes:

• Browser and operating system — your browser name and version, operating system, platform, and CPU architecture.
• Display and screen — screen resolution, viewport dimensions, pixel density, color depth, color scheme preference, orientation, refresh rate, and motion or data-saving preferences.
• Network conditions — effective connection type, estimated downlink speed, round-trip latency, and data-saver status as reported by your browser.
• Performance metrics — page load and rendering timings, including metrics such as First Contentful Paint, Largest Contentful Paint, and Time to First Byte, used to monitor and improve platform performance.
• Media capabilities — supported audio and video codecs and playback characteristics as reported by your browser.

This technical information is collected to ensure platform compatibility, optimize performance, and support security and abuse-prevention measures. It is not used to build advertising profiles or shared with third parties for marketing purposes.

Support and Feedback

When you contact us through our support or bug report features, we store the content of your submission along with any account information needed to respond to your request.

We use the information we collect exclusively to provide, operate, and improve the Memescale platform. Specifically, we use your information to:

• Authenticate your identity and authorize access to your account and bots
• Provision, configure, deploy, and operate your Telegram bot(s)
• Train and deliver custom AI character models based on images you provide
• Store and serve generated images through our infrastructure
• Enforce usage limits and maintain platform integrity
• Detect, investigate, and prevent fraudulent, abusive, or unauthorized activity
• Respond to your support requests and bug reports
• Fulfill your subscription and process payments

We do not use your information to serve advertisements. We do not build behavioral profiles for marketing purposes. We do not use your content to train generalized AI models outside of the character model you explicitly request for your own bot.

We do not sell your personal information. We share information only in the limited circumstances described below.

Service Providers

We work with third-party providers who help us operate the platform. These providers only receive the information necessary to perform their specific function and are not permitted to use it for any other purpose.

Legal Requirements

We may disclose your information if we believe in good faith that doing so is required by applicable law, regulation, legal process, or enforceable governmental request, or to protect the rights, property, or safety of Memescale, our users, or the public.

We retain your information for as long as your account remains active or as needed to provide you with our services. Specific retention periods are as follows:

When you request deletion of your account, we remove your active data from our systems. Residual copies in backup systems are purged on the next scheduled backup rotation.

We implement technical and organizational measures designed to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include:

• Per-account filesystem isolation and access controls
• Atomic file writes and concurrency locking to prevent data corruption
• Bot tokens and API credentials stored in environment-isolated files with restricted operating system permissions
• All API requests validated against authenticated sessions before any account data is accessed or modified
• Encrypted connections for all data in transit

No method of transmission over the internet or electronic storage is completely secure. While we take these protections seriously, we cannot guarantee absolute security.

You have the right to access, correct, or request deletion of the personal information we hold about you. To exercise any of these rights, contact us at support@memescale.ai.

When you request account deletion, we will remove your bot configuration, training images, and generated images from our active systems. Certain information may be retained where required by law or for legitimate business purposes such as fraud prevention or financial recordkeeping.

Because we use Telegram as our authentication mechanism, you can also revoke access by contacting us to delete your account — we do not maintain a separate credential system that you would need to manage independently.

Our services are strictly intended for individuals who are 21 years of age or older. We do not knowingly collect personal information from anyone under the age of 21. If you believe we have inadvertently collected information from a person who does not meet this age requirement, please contact us at support@memescale.ai and we will take steps to delete that information promptly.

We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date at the top of this page. We encourage you to review this policy periodically to stay informed about how we are protecting your information.
